    Here is the letter I received from the prosecuting attorney in Tucker County West Virginia in reference to the "deliberate" I was involved in.

    Dear Mr. Hebert:

    On 11/27/07, Mr. Simmons pled no contest to drunk driving. The Magistrate sentenced him to 24 hours. In jail, fined him $100.00 plus $240.50 court cost. For leaving the scene of and accident, he also pled no contest. The Magistrate charged him $1.50 fine plus $165.50 court cost. He will also lose his driver’s license for 6 months. He will not be able to get his license returned until he completes the West Virginia Alcohol treatment class. This is an additional expense of approximately $350.00. The class usually lasts 6 weeks, but longer if you continue drinking.

    If he is caught driving now, he must spend a minimum of 6 months in jail.


    This is why we need federal mandated laws on things like drunk driving, murder, rape, etc.

    I bet if he killed one of us he would have been charged $2.50.

    What a friggin joke!!!!

    I wouldn't be surprised if the 'magistrate' was a relative. The Good Ole Boy system is firmly in place in WV. As a native and former West Virginian, I am sorry you had such a bad experience while visiting.

      Steve, I too am very disappointed in the outcome of this case and I believe
      "punishment" of this degree not only is unfair to the victims but also does nothing to deter these criminals from repeating and endangering others with the same behavior. i.e. the horrible crash just yesterday morning on I-459 where someone was driving north in the southbound lane and caused a grinding head on collision killing both drivers instantly. Alcohol is strongly suspected...sad...really sad.
      I am just so thankful that you and Krista were not seriously injured. Kind of scary to think that we are all subjected to this kind of danger every time we leave home...no matter what the mode of transportation....

          We did have to sue him, but through his insurance company. That is how we got the bike and gear paid for. They wanted to settle without any proceedings. I wonder why?

            Justice served... reminded me again...

            Long story short version...

            Part time farm employee break into my truck, steal checks, forges the two checks, cash them... I catch him via my security ... I approach him, he confesses... I swear out warrant...

            I persuade him to turn himself in...he does to the county sheriff... He signs a confession, arrested, bailed out... we go to grand jury... our District Attorney and Grand Jury failed to get a bill on him...they send me letter and set him free....

            I and Sheriff appeared before grand jury with signed confession, copies of checks and other documents.

            Not third world country...Lamar County, Alabama...

            My attorney's comment: the DA can make the grand jury eat cabbage sandwiches for lunch and they will enjoy them too.....

            I can document every word....

              I asked for letters to be sent to the prosecuting attorney to help in this case. I know a few of you sent them. Now I will ask everyone to send a reply about this injustice. Here is the contact information:

                No one will agree with me but I think the only justice you will get in these situations, where you are dealing with low life, blood sucking, worthless people, is to simply get even with them. It might take you a little while and you might have to do a little detective work, but you CAN get even. Also, provided you aren't injured when the drunk hits you, just beat the holy crap out of him before the cops get there . This is my kind of justice!! Gail

                  You have to stop going to those liberal think-tank meetings now. I have never read so much commie-pinko-bleeding-heart bulls**t in one little message in my life. Get with the program.

                  actually, Steve this is a parallel with the US Rep. from SD getting his wrist slapped for running over and killing a motorcyclist a couple of years bad. Just be thankful you and your daughter were not seriously injured.

                  Hell, Angie and I have to go to court tomorrow to settle up our speeding tickets. I think the combo fines will be $316 or about what this jerk had to pay for DUI and hit and run.

                    Gail,

                    I like how you think! That went through my mind several times. If he would have stopped, would I have grabbed him and beat the snot out of him? When I was picking up the bike the next day from the tow yard the owner let me know that old Harry would be by to get his belongings out of his vehicle as well. I thought about hanging around, but I wa the minority in "bubba land" and no good would have come of it. I did not want Krista to see that side of me anyways.

                    It is pure crap. We have got to get these offenes that are tolerated by our legal system fixed

                    On a happier note, Merry Christmas to everyone and I hope to see you all in Montevallo.

                            Just don't forget to untie Paul before you go on your vigilant hunt. Guess the State Troopers knew Angie and I had been hanging around with you, that's the reason they stopped us - thanks. The others can do what they want, but I am staying clear of you. Last time we spent the night together I was arrested the next day (that ought to get everybody talking.) BTW, the judge dismissed our case today, but had to pay court cost. No matter, it ain't on our records and don't go to the insurance people. Guess Hebert will be pissing and moaning that we got off light too. Truth is he just don't want to see any good ol' boys get a break.
